1. Services and Products
We provide flooring materials, “cash and carry” warehouse sales, and professional installation services. All products and services are subject to availability. We reserve the right to discontinue any product at any time.
Product Displays We make every effort to display as accurately as possible the colors and images of our products that appear on the Site. We cannot guarantee that your computer monitor’s display of any color will be accurate. Actual flooring samples may vary slightly from the images shown online.
2. Estimates and Quotes
Free In-Home Estimates We offer free in-home estimates for our services. An estimate is provided for informational purposes and does not constitute a binding contract until a final sales agreement is signed.
Pricing Validity Quotes are generally valid for a specific period as noted on your estimate. Prices are subject to change based on material availability and market fluctuations after the expiration of that period.
Unforeseen Conditions Estimates are based on visible conditions. Additional charges may apply if unforeseen structural or subfloor issues (such as water damage, uneven subflooring, or rot) are discovered during the removal of old flooring or installation of new flooring.
3. Orders and Payments
Payment Terms Payment terms will be outlined in your specific sales agreement. Generally, a deposit may be required to secure materials and schedule installation, with the balance due upon completion of the work.
Special Orders Custom or special-order materials that are not in our standard warehouse stock may require full payment in advance and are typically non-refundable and non-cancellable once the order is placed with the manufacturer.
4. Installation and Site Preparation
Customer Responsibilities To ensure a smooth installation process, the customer is responsible for:
- Securing or removing breakable items, knick-knacks, and valuables from the work area.
- Ensuring adequate lighting, electricity, and temperature control in the installation area.
- Providing clear access to the work area.
Schedule Changes We strive to adhere to scheduled installation dates. However, delays may occur due to manufacturer shipping delays, weather, or other unforeseen circumstances. We will communicate any schedule changes to you as soon as possible.
5. Returns and Refunds
Warehouse Sales For “cash and carry” purchases from our warehouse, returns are subject to our in-store return policy. Generally, unopened and undamaged stock materials may be returned within a specified timeframe, potentially subject to a restocking fee.
Installed Products Once flooring has been cut or installed, it cannot be returned. If you believe there is a defect in the material or workmanship, please contact us immediately so we can assess the issue under the applicable warranty.
6. Warranties
Manufacturer Warranty Most flooring products come with a manufacturer’s warranty. We will pass through any applicable manufacturer warranties to you. These warranties typically cover defects in materials but do not cover damage caused by misuse, accidents, or improper maintenance.
Installation Warranty We stand by our craftsmanship. Specific details regarding our labor or installation warranty will be provided in your sales agreement.
7. Limitation of Liability
In no event shall American Carpet & Floors, its directors, employees, or agents be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Site or our services, strictly to the extent permitted by Michigan law. Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you to us for the specific product or service at issue.
8. Intellectual Property
The Site and its original content, features, and functionality are owned by American Carpet & Floors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any legal action or proceeding related to this Site or our services shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Michigan.
